1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Kamfinsa Day Secondary School website (the "Site") and any services, content, or applications provided by Kamfinsa Day Secondary School ("we," "us," or "our"). By accessing or using the Site, you agree to comply with and be bound by these Terms.

These Terms apply to all visitors, users, parents, guardians, students, and others who access or use the Site ("Users"). If you are agreeing to these Terms on behalf of a minor, you represent that you have the legal authority to bind that minor to these Terms.

8. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimer of Warranties

10. Limitation of Liability

In no event shall Kamfinsa Day Secondary School, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Site
• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content

This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

11. Indemnification

You agree to defend, indemnify, and hold harmless Kamfinsa Day Secondary School and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Zambia, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Chingola, Zambia.

13. School-Specific Policies

13.1 Student Conduct

Use of the Site by students is subject to the school's code of conduct. Any violations of these Terms may also constitute violations of school policies and may be subject to disciplinary action.

13.2 Academic Integrity

The Site may contain resources to support student learning. Users agree not to use these resources to engage in academic dishonesty, including plagiarism or cheating.

13.3 Parental Responsibility

Parents and guardians are responsible for monitoring their children's use of the Site and ensuring compliance with these Terms.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Kamfinsa Day Secondary School regarding our Site and supersede and replace any prior agreements we might have between us regarding the Site.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Force Majeure

We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation.
